Professor Chris Mirasola recently published Common Heritage as Public Trust: A Property Law Approach to Managing Resources Beyond National Jurisdiction, in the Southern California Law Review. The article considers disputes about entitlement to resources in areas beyond national jurisdiction, focusing particularly on the deep seabed, outer space, and the prevailing "common heritage of mankind" legal regime. Taking cues from the domestic public trust doctrine, the article argues for a resource-dependent and contextual approach to rethinking what it means for a resource to be the "common heritage" of all humanity. You can find the piece at https://southerncalifornialawreview.com/2024/10/31/common-heritage-as-public-trust-a-property-law-approach-to-managing-resources-beyond-national-jurisdiction/
