Course Outline: Mediation Advocacy is a simulation, skills-based class that will teach you the art and skill of utilizing mediation to negotiate disputes. Most lawsuits settle and, in Harris County, most courts require participation in mediation before setting a case for trial. This course will: (1) expose students to mediation practice, early dispute resolution (EDR), and general negotiation techniques; and (2) provide students with the skills needed to represent clients effectively in mediation. Students will participate in at least one mock mediation and will learn from experienced mediators, practicing lawyers, and entrepreneurs who will participate as guest speakers. Professor Moulton is also a trial lawyer with over 30 years experience.

Course Notes: (Face-to-Face)   The UH registration system instruction mode for this course is listed in parenthesis. For this instruction mode, instructors and students are expected to normally be physically present in the classroom. If the course has a final examination, it will be in a classroom requiring your physical presence. Other assessment, such as a mid-term exam, may also be in a classroom. Whether this instructor will offer “remote presence” (starting a zoom meeting from the podium computer to enable student remote access on an occasional basis) for part or all of the semester is not known, but students should not rely on an expectation that remote presence will be available.
