June 29, 2023 — In a 6-3 ruling today, the Supreme Court struck down affirmative action in college admissions.
The court cases are Students for Fair Admissions, Inc., Petitioner v. President and Fellows of Harvard College and Students for Fair Admissions, Inc., Petitioner v. University of North Carolina, et al.
Emily Berman, a constitutional law professor at the University of Houston of Law Center commented on the court’s decision:
“In an opinion that surprised precisely nobody, Chief Justice Roberts and the five other Republican appointees on the Supreme Court jettisoned decades of precedent permitting institutions of higher education to consider race as one factor among many in making admissions decisions. Declaring that such policies no longer satisfy the Equal Protection Clause of the Fourteenth Amendment, the majority hamstrings colleges and universities seeking to assemble diverse student bodies that reflect all of America, rather than merely its privileged castes.”
