Robert L. Tsai. America's forgotten constitutions: defiant visions of power and community. Harvard University Press, 2014.

Taking a novel approach to American constitutional history, Tsai examines eight alternative constitutions written by political radicals and separatist groups, from the abolitionist John Brown to the contemporary Aryan movement. These documents, and the stories of how they came to be written, raise fundamental questions of power, community, and the political process.

Omri Ben-Shahar and Carl E. Schneider. More than you wanted to know: the failure of mandated disclosure. Princeton University Press, 2014.

Mandated disclosure requires one party to an agreement to give information to the other (think doctor’s consent forms, or software license agreements). According to Ben-Shahar and Schneider, it “may be the most common and least successful regulatory technique in American law.” This book focuses on mandated disclosure in the areas of consumer protection and health law, and suggests that there are more effective solutions to regulatory problems.
