Duane Champagne & Carole Goldberg. Captured
justice: Native nations and Public Law 280. Carolina Academic Press,
2012. KF8210.C7C48 2012 Captured
Justice
examines the success or failure of the Public Law 280 program which
substituted state for tribal and federal criminal justice in Indian country.
First, Duane Champagne and Carole Goldberg pinpoint a set
of six conditions which are needed for criminal justice to be successful in
Indian country. Then, the authors lay out the results of over a hundred
interviews and surveys from sixteen reservations across the United
States. Their objective is to discover how the state jurisdiction
regime is performing and to compare experiences on Public Law 280
reservations with those on non-Public Law 280 reservations. |

Thorsten
Käseberg. Intellectual property, antitrust and cumulative innovation in
the EU and the US. Hart, 2012. K3850.K37
2012 In Intellectual property, antitrust and
cumulative innovation in the EU and the US, Thorsten Käseberg examines both IP and antitrust rules and evaluates
policy levers under European and US patent, copyright and trade secrecy
laws. The author discusses such issues as the bar for and scope of
protection as well as research exemptions, compulsory licensing regimes and
misuse doctrines. The book considers what the distribution of tasks is and
should be between these IP levers and antitrust rules. Particular
consideration is paid to the essential facilities doctrine, including pricing
methodologies for access to IP. |
