Thirteen ways to steal a bicycle: theft law in the information age,
Stuart P. Green notes that the last significant reforms in Anglophone theft
law, which occurred nearly fifty years ago, flattened moral distinctions,
such that the same punishments now are assigned to much different offenses.
Unreflective of community attitudes regarding theft, which favor degrees in
blameworthiness according to what is stolen and under what conditions, and
uninfluenced by developments in criminal law theory, theft law cries out for
another reformation. |

Laitos reviews the history of man’s relationship with the natural environment
and develops new ways of thinking about the protection of nature. Instead of
proceeding with man-based objectives, Laitos argues that man should protect
the environment for its own inherent worth. Rather than giving humans more
and more rights to clean up the environment, and to curb resources depletion,
a right of nonuse held by the resource itself should exist. Natural resources
have always had this parallel nonuse function, and people should recognize
and legitimize it. |
