John
D. Bessler. Cruel & unusual : the American death penalty and the
founders' Eighth Amendment. Northeastern University Press, c2012. KF9227.C2B478
2012 The conventional wisdom is that the founders were avid death penalty supporters. In this examination of America’s Eighth Amendment, the author explores this myth and shows the founders’ conflicting and ambivalent views on capital punishment. The book takes the reader back in time to show how the indiscriminate use of executions gave way to a more enlightened approach—one that has been evolving ever since. After critiquing the U.S. Supreme Court’s existing case law, this volume argues that America’s death penalty—a vestige of a bygone era in which ear cropping and other gruesome corporal punishments were thought acceptable—should be declared unconstitutional. |

Julian
Ku, John Yoo. Taming globalization : international law, the U. S.
Constitution, and the new world order. Oxford University Press, 2012. KF4581.K8
2012 In 1997, a Mexican national named Jose Ernesto Medellin was sentenced to death for raping and murdering two teenage girls in Texas. In 2004, the International Court of Justice ruled that he was entitled to a new trial, but in 2008, amid fierce controversy, the U.S. Supreme Court declared that the international ruling had no weight. Medellin subsequently was executed. In this book, the authors contend that the Medellin case only hints at the legal complications that will embroil American courts in the twenty-first century. To reconcile the demands of globalization with a traditional, formal constitutional structure, they write, we must re-conceptualize the Constitution, as Americans did in the early twentieth century, when faced with nationalization. |
