Course Outline: Health Law Financing, Organization & Quality surveys legal and regulatory mechanisms--such as tort liability, regulation, and informal oversight--for promoting healthcare quality. It also explores the structure and financing of heathcare (restrictions on corporate practice of medicine; the role of nonprofits; licensing and accreditation; fraud and abuse; and the impact of ERISA preemption on state regulation). The focus is on institutions (e.g., hospitals, nursing homes, payers, managed care organizations) rather than on the physician-patient relationship. Students who have taken Health Law Survey II (Access, Regulation, and Enterprise) may not receive credit for this course.
