Course Outline: This course will cover many aspects of federal income tax issues related to real estate acquisition, operation and disposition. Particular emphasis will be placed on capitalization and cost recovery, and the effects of mortgages on basis, amount realized and cancellation of indebtedness. We will also cover choice of entity for all aspects of real estate operations, dealer gain issues, like kind exchanges, leasing issues and installment sales. Some attention will be given to primary residence issues and passive activity loss rules. The course is intended to be practical and cover federal income tax issues that arise daily for both clients and lawyers involved in commercial and investment real estate transactions.
