Course Outline: This course will examine the historical relationship between baseball and the law. Materials and discussion will focus primarily on the interrelationship between law and professional baseball with some references to amateur baseball as well. The course will explore baseball historic antitrust exemption, player contracts, intellectual property and licensing rights for both owners and players, gender equity issues, labor law and collective bargaining with a detailed examination of the CBA for MLB, baseball’s salary arbitration system, tort liability dealing with owners, players and fans, violence in baseball, player agents, drug testing and the powers of the commissioner.
