Course Outline: This course is designed (i) to expose students to the most essential doctrines of the law of trusts and the law of wills in the context of the law of gratuitous transfers in general; (ii) to familiarize students with significant provisions of statutory laws (including the Texas Probate Code and the Texas Trust Code) of relevance in these fields; and (iii) to help students develop critical problem solving skills in the law of trusts and the law of wills.

Required text: Dukeminier & Sitkoff, Wills, Trusts, and Estates (10 Edition, 2017) th published by Wolters Kluwer [PLEASE NOTE THAT THE 10 EDITION IS TH BEING RELEASED AND SHOULD BE AVAILABLE BY THE BEGINNING OF THE FALL SEMESTER. PLEASE DO NOT PURCHASE THE 9 EDITION AT TH THIS TIME.]
Also Required*: The 2017 edition of Johanson’s Texas Estates Code Annotated published by Thomson Reuters Westlaw. Alternative option: Jones McClure Texas Estates Code Plus 2017-2018 edition. [SINCE THE LEGISLATURE IS MEETING THIS YEAR, THERE WILL BE CHANGES IN THE ESTATES CODE AND TRUST CODE. THEREFORE, THE 2015 AND 2016 VERSIONS OF THE STATUTE BOOKS WILL NOT CONTAIN THE 2017 CHANGES IN THE LAW.]
*There are various statutes which are relevant to the class: Estates Code, Property Code (which contains the Trust Code), Insurance Code, Family Code & Health & Safety Code. The above two statute books contain the relevant statutes we will cover in the class plus helpful commentary. I realize these books are expensive. If you choose not to purchase them, you will need to have access to the above-mentioned codes
