Course Outline: The course approaches trademarks from both historical and modern (i.e., internet) settings and deals with related issues of unfair competition such as commercial disparagement/defamation, right of publicity, privacy rights, and false advertising. It contrasts the predominantly use-based trademark system in the United States with registration-based systems in other countries. It examines ways in which an organization can develop, register, and assert trademark rights, as well as methods for enforcing those rights focused predominantly on the trademark infringement and dilution actions.
