In the ongoing debate over counterterrorism, one subject that has received relatively little attention is the legal framework of the United States government’s “No Fly List.” In Mrs. Shipley’s Ghost, constitutional law scholar Jeffrey Kahn examines the history of government travel restrictions going back to the early days of the Cold War, when a civil servant named Ruth B. Shipley—chief of the State Department’s Passport Office from 1928 to 1955—invented a system for identifying citizens whose travel was “not in the interests of the United States.” Professor Kahn argues that the right to travel is an integral part of citizenship in a democratic republic, and in the book’s closing chapters he suggests a new approach to reconciling this right with legitimate security concerns.

This timely book provides a survey of international laws designed to address data privacy, as well as a detailed analysis of a number of national laws, highlighting their similarities and differences. The author is an expert on information and communications technology who has served as a policy advisor for the EU Commission and the UK House of Lords Constitution Committee, and is currently a professor at the Norwegian Research Center for Computers and Law, University of Oslo.
