In Crime and
Punishment in Islamic Law: Theory and Practice from the Sixteenth to the
Twenty-first Century, Rudolph Peters examines the creation and implementation
of Islamic criminal law from the 16th century to the 21st century. The
author starts by reviewing the initial creation of Islamic criminal law
by Muslim scholars. He then examines how Islamic criminal law was implemented
by various Muslim countries during the subject time period. Much of the
review centers around criminal law in the Ottoman Empire because the empire’s
detailed criminal justice records are still available. Finally, the book
reviews the fate of Islamic criminal law after the Muslim countries were
colonized by Western nations. Some colonial governments immediately replaced
the Islamic criminal law with western criminal codes, while other countries
incorporated Islamic criminal law into their colonial legal system.
The Witnesses: War Crimes and the Promise of Justice in The Hauge
of Pennsylvania Press 2005
In The Witnesses: War Crimes and the Promise of Justice in the Hauge, author Eric Stover reviews the experiences of witnesses who testified at the International Criminal Tribunal for the former Yugoslavia (ICTY). Stover was inspired to research and write this book after he discovered that the many victims of the Yugoslavia war crimes held the UN court in very low regard. The book reviews the theoretical goals of the court and the actual experiences of the war crime witnesses.
Stover states that he had three goals in writing the book:
1. Examine the motivations, attitudes, and experiences of war crime witnesses who testified in the court, and determine any positive or negative consequences that the witnesses experienced as a result of their testimony.
2. Provide the judges and lawyers of the Hague tribunal and other international courts with insight into the experiences of war crime witnesses, so that the tribunals may better meet the needs of future witnesses.
3. Move the debate
about justice away from a discussion of abstract ideas, and towards a
more grounded examination of how the actions of the court affect the everyday
lives of war crime victims.
