DESIGNATION OF SAFETY DRIVING COURSE

QUESTION: Where a defendant elects to take a safety driving course in
lieu of other penalty, may the judge designate a specific agency and course that the
defendant attend?
ANSWER: Assuming that there is more than one agency offering a safety
driving course, the committee is of the opinion that the judge may not designate a
specific agency because Canon 2B prohibits a
judge from lending the prestige of his or her office to advance the private interests of
others.
