H. Redish. The
adversary First Amendment: free expression and the foundations of American
democracy. Stanford University Press, 2013. KF4770.R428
2013 The Adversary First Amendment is a rethinking of the theory of free speech. The author rejects the traditional view that free speech protects democratic institutions indirectly by allowing a vigilant individual to identify and expose threats to freedom that are then collectively stopped. Instead, the author argues that free speech preserves democracy directly by allowing individuals to attempt to harness the collective power of government to serve that individual’s interests, providing food for thought whether the reader likes or dislikes the ramifications of this viewpoint. |
