Kenneth W. Mack. Representing the race: the creation of the
civil rights lawyer. Harvard University Press, 2012. KF372.M33 2012 This book
tells the story of an enduring paradox of American race relations, through
the prism of a collective biography of African American lawyers who worked in
the era of segregation. Practicing the law and seeking justice for diverse
clients, they confronted a tension between their racial identity as black men
and women and their professional identity as lawyers. Both blacks and whites
demanded that these attorneys stand apart from their racial community as
members of the legal fraternity. Yet, at the same time, they were expected to
be “authentic”—that is, in sympathy with the black masses. The stories of
these lawyers pose the unsettling question: what, ultimately, does it mean to
“represent” a minority group in the give-and-take of American law and
politics? |

Jeremy Waldron. Partly laws common to
all mankind: foreign law in American courts. Yale University Press, 2012. KF358.W35 2012 This book examines the propriety of
United States court judges citing to foreign law in their rulings. The
occasional citation of foreign law by the United States Supreme Court,
especially in constitutional cases, is interpreted through the lens of legal
theory and jurisprudence. The book argues that nations are governed not only
by their own laws, but also in part by laws common to all mankind. This
foundation paves the way for the book’s key assertion: common law is
not natural law but a grounded consensus among all nations. As a consequence
of this, it is suggested that this consensus, and citation to foreign laws,
will become increasingly important in jurisprudence and public affairs as the
world becomes more globalized. |
