This book examines the intersection of children, law and disasters like Hurricane Katrina. It looks at the experiences of children during the disasters and the first response to the events in order to demonstrate how we can do a better job for children. It acknowledges the considerable stress on systems such as juvenile justice, foster care, and education before the disasters and what needs to happen in a post-Katrina world. The book stresses the opportunity to examine and engage the problems that were exposed by disasters like Katrina and create effective policies for children in these all important systems. It also takes a longer view about the implications of an agenda focused on children's needs for public policy in general. It provides a much-needed tool to develop policies and plans for the future.

This book proposes a wholesale renovation of legal ethics, one that contributes to ethical thought generally. Markovits reinterprets the positive law governing lawyers to identify fidelity as its organizing ideal. Unlike ordinary loyalty, fidelity requires lawyers to repress their personal judgments concerning the truth and justice of their clients' claims. Next, the book asks what it is like--not psychologically but ethically--to practice law subject to the self-effacement that fidelity demands. Finally, it reintegrates legal ethics into political philosophy in a fashion commensurate to lawyers' central place in political practice. Lawyerly fidelity supports the authority of adjudication and thus the broader project of political legitimacy. Throughout, the book rejects the casuistry that dominates contemporary applied ethics in favor of an interpretive method that may be mimicked in other areas. |
