This book continues the author's focus on the effect of advances in information technology upon the law and legal practice, providing fresh perspectives and analysis of anticipated developments in the decade to come. In particular, he aims to explore the extent to which the role of the traditional lawyer can be sustained, in the face of the challenging trends in the legal marketplace and the new techniques and technologies for the delivery of legal services.

This book offers an unprecedentedly detailed comparative critique of Anglo-American Corporate Bankruptcy Law. It challenges the standard paradigm that US law is pro-debtor and UK law is pro-creditor, suggesting that there is some evidence of functional convergence in practice including an increasingly market-oriented focus in the US. The focus is on corporate restructurings with in-depth scrutiny of Chapter 11 of the US Bankruptcy Code and the UK Enterprise Act, both of which borrow the best features from the other. |
