Raymond T. Nimmer

Licensing of Intellectual Property and Other Information Assets

LexisNexis Matthew Bender, 2007

KF2979.N45 2007

This book, written by Law Center dean Raymond T. Nimmer, combines traditional case law and materials along with problems to allow coverage of this field in either a case law-based or problem-based course. It deals with traditional areas of intellectual property and information licensing, and also modern issues associated with digital and online transactions. It also covers antitrust, misuse, and preemption issues in licensing.

The problem materials also contain drafting exercises and issues, reflecting the contractual nature of licensing law.

Mediation and Negotiation: Reaching Agreement in Law and Business

LexisNexis Matthew Bender, 2007

KF9084.T73 2007

These materials, co-authored by Law Center professor Stephen K. Huber, focus mainly on business transactions, although there are some discussions of criminal law. This book is divided into five parts. Part I introduces the subject matter, and examines dispute resolution generally. Part II introduces negotiation. Part III is composed of three chapters devoted to mediation—facilitated negotiation. Part IV examines additional ADR processes and procedures that involve the use of a third party neutral. This part also considers government use of ADR and negotiated rulemaking. Part V considers the dispute resolution professional including qualifications and standards, potential errors and omissions liability, ethical issues, and systems design.

Evidence: Cases, Materials, and Problems

LexisNexis Matthew Bender, 2006

KF8934.R68 2006

The third edition of Evidence: Cases, Materials, and Problems, co-authored by Law Center professor David Crump, is based on the idea that the Federal Rules of Evidence, their state progeny, and cases arising under them, are the major factors in the teaching of Evidence today. The authors have made some changes to build the book more explicitly around the Rules. The materials cover a wide range of perspectives from pragmatic to philosophical issues, as well as new approaches to evidentiary analysis. Textual explanations, rules, cases, notes, questions, problems, jury instructions, articles, proposals, legislation, and excerpted testimony are all included throughout.

Arbitration: Cases and Materials

LexisNexis Matthew Bender, 2006

KF9085.A7H83 2006

The materials in this edition of Arbitration: Cases and Materials, co-authored by Law Center professor Stephen K. Huber, have two objectives: to provide an introduction to the law of arbitration, and to show how arbitration works in a variety of contexts. Arbitration is strongly favored by the courts, and judicial review of arbitration awards is very limited.

This book focuses mainly on contract-based, binding commercial arbitration, which includes employment disputes and arbitration pursuant to a collective bargaining agreement.

The Law of Asset Forfeiture

LEXIS, 2004

KF9747.G87 2004

Co-authored by Law Center professor Sandra Guerra Thompson, The Law of Asset Forfeiture distinguishes the materials applicable to civil and criminal forfeiture. Attention is also paid to the most important affirmative defenses, many of a constitutional nature, as well as the non-judicial forms of relief available to property owners.
