A history of American contract law around the turn of the twentieth century, this book details shifts in the American conception of contract by juxtaposing scholarly accounts of contract with case law, and shows how the cases exhibit conflicts for which scholarship offers just one of many possible answers.

The author argues that our current understanding of contract was shaped by a revolution in private law undertaken toward the end of the nineteenth century, when legal scholars established calculating promisors as the centerpiece of their notion of contract.  Areas of central concern include the enforceability of promises to make gifts; the relationship of contracts to speculation and gambling; and the problem of incomplete contracts.

Instead of being a reference tool as indicated by the title, this book is an in-depth analisys on the extent of the power of Congress, particularly the limitations of legislative power granted by the Constitution, as well as judicial precedent set by the Supreme Court.  The author concentrates on three issues: the legislative authority conferred by the "necessary and proper clause" of Article 1, the authority of Congress to delegate power to courts and executive agencies, and the power to investigate.  By examining the historical development of the Constitution as well as judicial precedent set by the Supreme Court, the author develops a systematic account of federal legislative power that is suitable for those interested in constitutional history and political science.
