Wawro and Eric Schickler Princeton : Princeton University Press, c2006. JK1161.W38 2006 Filibuster, the popular name for parliamentary obstruction, has long been a familiar political term. In this book, the authors explain how the Senate managed to satisfy its lawmaking role during the nineteenth and early twentieth century, when it lacked seemingly essential formal rules for governing debate. They show that, although its institutional behavior was guided by inherited rules, the Senate itself was not immune from fundamental rule changes. Time and again the threat of rule changes actually prevented the Senate from devolving into parliamentary chaos in a system where filibusters played out as wars of attrition. Through a combination of extensive quantitative and case-study analysis, the authors point out how the larger institutional and political context--such as the expansion of the country and the move to direct election of senators--led to changes in the Senate regarding debate rules, and what effect these changes had on the functioning of the Senate. The authors then conclude the book with a discussion covering the battles over obstruction in the Senate's past through the recent conflicts over judicial nominations. A very timely topic indeed.

in philosophy to the analysis. The thesis of the book is that underlying
these fields of law are common principles, and that these principles can
be used to explain the history and development of the various areas of
private law.
