Working with the premise that the rapidly developing, politically charged and complicated area of tribal gaming law and policy is grounded in concepts that may be unfamiliar to practitioners, policymakers, and the public, the authors have undertaken a research guide. From beginning to end, they present significant questions in the area of tribal-state-federal relations and resources for researching Indian gaming. They state the following in the Preface: “This book grew out of our search for materials that straightforwardly and fully explained the law and policy of Indian gaming. By assembling such information in a single text, we hope to provide a readily accessible source for practitioners and policy makers, student and scholars, and anyone else interested….” More than one-third of the book is devoted to appendices to aid research.

defense in the pre-conviction phases of capital cases. One chapter is
about post-conviction relief. To complement his research in the literature,
White interviewed thirty-seven lawyers and mitigation specialists. Although
not named as an interviewee in the Methodology Appendix, the Law Center’s
David R. Dow, University Distinguished Professor and Director of the Texas
Innocence Network, is quoted in the book describing conduct of two Texas
attorneys said by White to be “blatantly incompetent attorneys … appointed
to represent Texas capital defendants.” In his concluding observations,
White states that “it seems clear that the post-Furman reforms designed
to reduce the death penalty’s arbitrary application have not been and
probably will not be effective.” He adds, however, that these reforms
“may have exacerbated the extent to which a capital defendant’s attorney
and defense team can affect the likelihood that the defendant will receive
a death sentence.” It appears that skilled defense attorneys
may now have more impact on the trial outcome than the nature of the crime,
the facts in the case, or the characteristics of the defendant, per se.
