In this study, which grew out of three Hersch Lauterpacht Memorial Lectures delivered at Cambridge in November of 2003, the distinguished international practitioner and scholar Jan Paulsson examines the ancient procedural principle of denial of justice. He traces its historical evolution and fundamental developments. An entire chapter is devoted to a discussion of its modern definition. This book is not merely a cerebral exercise; the text is replete with concrete examples from around the globe and up to the first years of this century.

As a program officer for the Seattle based National Bureau of Asian Research, the author began his field work in China in 1997. Over a seven year period, his work in China, supplemented by interviews with local and national officials, developed his understanding of the intellectual property milieu of contemporary China. The result is this book. He argues that “the direction of external pressure and the characteristics of the institutions it is designed to change are crucial to understanding the effects of pressure on policy enforcement outcomes”. With a description of how Chinese bureaucracies connect to each other, from the center to the local level, the author provides a lucid explanation of why some types of intellectual property rights are relatively well enforced and others are not. This study of the complexity of indigenous bureaucracies and exogenous forces frames the author's conclusions and raises issues for future consideration that are not only pertinent to intellectual property in China but to other issue areas and to other countries with similar institutions and state organization.
