expanded since the 1990’s. The law now enables music copyright holders
to enjoin public performance, broadcasting, the making of sound recordings
in any medium, and, in many jurisdictions, the sharing of music with the
aid of digital technology. More and more performances are considered public,
and the reproduction of even short samples of a song is potentially an
infringement if the original work is recognizable. In this volume the
author explores how attempts to combat music piracy are adversely impacting
musicians and composers. Demers demonstrates that the intellectual property
provisions that apply to music do not merely prohibit forms of music expression
and modes of consumption. The interpretation of these provisions actually
helps to shape the field of musical forms available to our society. In
sum, this volume is a study of shifting cultural values and new musical
practices generated in relation to a legal climate characterized by uncertainty
and change.
