status of environmental law, this casebook covers the broad range of federal
environmental law with emphasis on the National Environmental Policy Act,
the Clean Water Act, the Comprehensive Environmental Response, the Compensation
and Liability Act (CERCLA or Superfund), and the Endangered Species Act.
Another area of emphasis are the enforcement provisions by which government
agencies or citizens can enforce statutory or regulatory requirements
on violators. It omits discussion of the theoretical and policy issues
that underlie environmental statutes and their implementation in regulations,
and devotes a limited coverage of the constitutional, administrative,
and common law aspects of environmental law as separate areas of study.
This book thus shows how significant environmental programs operate, and
demonstrates how remaining ambiguities are resolved by both agencies and
the courts. |
