Policy Statement on Grandchild Visitation Rights

The Center for Children, Law & Policy created a policy statement in response to the following interim charge from the Texas State Senate Jurisprudence Committee -

Study the laws governing suits affecting the parent-child relationship involving non-parents, including suits for possession of or access to a child by a grandparent, and make recommendations for providing the best care and protection for the children involved. Provide an assessment of the constitutional issues involved with these suits.

This analysis was conducted in light of 2007-2008 Texas family code (FAM 153.433-434) that allows that courts to order possession or access of a grandparent to a biological or adopted grandchild if at least one of the parents still have legal parenting rights, if the grandparent can prove by a preponderance of evidence that denial would "significantly impair the child's physical health or emotional wellbeing," and focuses on the Constitutional issues raised by the United States Supreme Court case Troxel v. Granville, (99-138) 530 U.S. 57 (2000) 137 Wash. 2d 1, 969 P.2d 21, affirmed.


Policy Statement on DFPS Rules Governing Fire Inspections at Foster Homes

The Center for Children, Law & Policy created a policy statement in response to 40 TAC § 749.2903, relating to required fire inspections in foster homes suggesting alternatives that would maintain adequate safety procedures without discouraging current and potential foster parents from helping to alleviate an already taxed foster care system.
