The Tokyo War Crimes Trial : the Pursuit of Justice in the Wake of World War II

This book assesses the historical significance of the International Military Tribunal for the Far East (IMTFE)—commonly called the Tokyo trial—established after World War II.  Through extensive research in Japanese, American, Australian, and Indian archives, Yuma Totani uses a large body of previously underexamined sources to dispute the notion that the trial was an exercise in “victors’ justice” in which the legal process was egregiously compromised.  Instead, Totani details the achievements of the Allied prosecution teams in documenting war crimes and establishing the responsibility of the accused parties to show how the IMTFE represented a sound application of the legal principles established at Nuremberg.

Delegation of Governmental Power to Private Parties : a Comparative Perspective

Through a comparative analysis of England, the European Union, and the United States, this book considers legal responses to delegation of governmental power to private parties. Donnelly argues that although private delegation has the potential to enhance governance, it should not be assumed to have this result, and can also create risks to democracy, accountability, and human rights. The author believes that, at present, the response of all three jurisdictions to private delegation is inadequate. She believes a greater awareness of the risks and a greater sense of responsibility on the part of the judiciary are required if the three legal systems are to respond appropriately.
